INSTRUCTIONS BEFORE REGISTERING TO USE CA2 PUBLIC DIGITALSIGNATURE AUTHENTICATION SERVICE, PUBLIC REMOTE DIGITAL SIGNATURE ANDCERTIFICATE AUTHORITY SERVICES CA2 MOBILE SIGN

1. Information to know about Public Digital Signature Certification:

- Digital authentication: Is a form of electronic certificate issued by a public digital signature certification service provider, used to identify subjects as organizations/individuals on the computer environment and the internet.

- Digital signature: Can be understood as an electronic seal / electronic signature of the organization / individual issuing documents and documents in electronic transactions. Digital signatures, in addition to being used for online tax declaration, can be used in other electronic transactions such as e-customs, social insurance (i-Van) and other public services.

- Legality of digital signatures: The Law on Electronic Transactions 2005 and Decree 130/2018/ND-CP detailing the law on electronic transactions on digital signatures and digital signature authentication services. - Security of digital signature information: A technically proven digital signature ensures security, is unique and cannot be forged. The digital signature is stored in a special device (USB Token), protected by a password, so it has a high level of security.

2. Preparation of registration documents:

a. For individuals: Identity card or Citizen ID card or passport

b. For organizations: Decision one establishment or decision stipulating functions, tasks, powers, organizational structure or certificate of enterprise registration or investment certificate, identity card, or citizenship card or the passport of the legal representative of the organization.

c. Individuals and organizations have the choice to submit a copy from the original, a certified copy, or submit a copy to be presented with the original for comparison.

3. Fees that customers need to pay:

- Service fee for using digital certificates (refer to CA2 public digital signature authentication service price list)

- Service fee for maintaining the system to check the status of digital certificates (According to Circular305/2016/BTC of the Ministry of Finance)

4. Payment method: Customers can pay by cash or bank transfer.

- Payment in cash: Customers pay cash and receive receipts from:

o CA2 direct sales officer (with aCA2 referral) or

 

o Officer of RA/DL authorized byCA2 (with copy or scan of Agent contract and referral letter from RA/DL)

- Transfer: Customers transfer to account information

5. Complaint process and complaint handling:

Step 1: Customers can complain, inquire about service-related issues via text, email, phone or directly at CA2.

Step2: The department that receives and handles complaints receives.

Step 3: Issues related to CA2'sservices and within the statute of limitations for complaints will be received and handled. Issues not related to CA2 services or issues beyond the statute of limitations for complaints will be notified in writing to the complainant and state the reasons for the refusal to accept the complaint.

Step 4: Issues can be handled immediately, for customers who complain directly at CA2 headquarters, the complaint-receiving and handling department responds directly to the customer and makes a complaint handling record. . Customers who do not complain directly but through other forms (such as email, text...) will be replied by text or email within 05 working days.

Step 5: Issues that cannot be handled immediately by the Receipt and Handling Department, will write a complaint handling receipt and send it to the customer.

Step 6: The Complaint Receipt and Handling Department, after writing the complaint receipt form, will classify it and forward it to relevant departments for investigation and clarification.

Step 7: The relevant departments investigate and verify, then transfer the information back to the Complaint Receipt and Handling Department.

Step 8: The complaint-receiving and handling department responds to the customer according to the investigation results of the relevant departments within 20 working days from the date of writing the complaint receipt.

Step 9: If the customer agrees with the answer, the Complaint Receipt and Handling Department will save the file and close.

Step 10: If the customer disagrees with the result in writing, the Complaint Receipt and Handling Department receives, investigates, verifies, and responds to the customer.

6. CA2's responsibilities in compensating when there are risks:

CA2 is committed to keeping the Client's information confidential in accordance with the Company's safety and security regulations and ensures not to provide this information to third parties unless requested by the competent State management agency. according to regulations of the Law.

Ensure the security of private information, personal information and trusted mobile devices in accordance with the provisions of the law on information security and other relevant laws.

Manage the use and storage of private data information for the right purposes.

Settlement of risks and compensations for subscribers:

a. Financial Responsibilities:

Bank guarantee under Decree130/2018/ND-CP

CA2 makes a deposit at Tien Phong Commercial Joint Stock Bank – Hanoi Branch with the amount of VND 5,010,000,000(Five billion, not a hundred and ten million VND) to settle risks and possible compensations in the future. service provisioning due to CA2 error.

Service insurance:

CA2 has professional liability insurance. Insurance is contracted for a continuous period and is renewed annually. Coverage will cover CA2's liability to the user and parties for material and immaterial damages within the limits set forth in applicable law. When an event that may result in a claim for damage occurs, the party must notify CA2 and the insurance company in writing within 7 days of becoming aware of the event. Coverage for immaterial and/or material damages suffered by the owner/person of the digital signature shall not exceed the amount specified bylaw.

b. CA2 is responsible for compensation for damage and risks to the Client in the following cases:

- Damage occurs when CA2 exposes key generation process, reveals secret key during transfer, stores secret key and subscriber's information.

- Damage occurs as a result of disclosure of subscriber information that CA2 is obliged to keep confidential.

- The damage is caused by posting on the digital certificate incorrect information compared to the information provided by the subscriber.

- Damage occurs as a result of non-compliance with the provisions of Clauses 2.3, Article 28 of Decree No.130/2018/ND-CP

- CA2 is responsible for indemnification according to the announced insurance levels.

7. CA2 disclaims responsibility in the following cases:

- Due to the Customer's violation of the law, rules and regulations on service exploitation while using the service; not pay service charges as specified in this contract.

- Customers using unsafe operating system and device environments: rooted devices, jailbreaking devices, devices without google protect certification, operating systems interfered with, devices with CA2 Mobile Sign APP installed from sources other than the Apple Store and Google Play Store…

- Customers reveal PIN, OTP or personal email access information registered as authentication channel.

8. Customer's rights and responsibilities:

- Allow service providers to collect customer information, manage and use personal information safely and for the right purposes. Agree to let CA2 publicize information about subscriber's digital certificate on CA2's digital certificate database.

- Provide complete documents and procedures in accordance with the regulations of the service provider.

- Have the right to request CA2 to suspend, withdraw the service and take responsibility for that request.

- Provide information according to regulations honestly and accurately to CA2.

- Request revocation of digital signature certificate in case of need
